These Terms of Service ("Terms") govern your access to and use of the Kamra website at kamrapms.com, the open-source Kamra software, and the paid services we offer around it (Kamra Cloud, implementation and support). By using any of these, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind it.
Kamra is built and operated by HeyKoala ("HeyKoala", "we", "us"), the brand of Koala AI Solutions Private Limited, a company incorporated in India with its registered office at 588, 3rd Stage, 4th Block, 10th Main Road, Near CBI, Basaveshwaranagar, Bangalore North, Karnataka 560079, India. The Kamra property management system is free and open-source software, licensed under the GNU Affero General Public License, version 3 (AGPL-3.0). Your rights to use, modify and redistribute the software come from that licence, and nothing in these Terms limits the rights the AGPL-3.0 grants you.
The software is provided "as is", without warranty of any kind, to the extent permitted by the licence and by law. If you self-host Kamra, you are responsible for your own installation, security, backups and compliance.
Separately from the free software, we offer optional paid services:
The specific scope, deliverables and price of a paid service are set out in the quote or order you accept. Those service-specific terms, together with these Terms, form our agreement for that service.
Fees are stated in your quote or order and are exclusive of applicable taxes unless stated otherwise. Implementation fees are one-time. Kamra Cloud and Support (AMC) are recurring and renew for successive terms unless you tell us not to renew before the current term ends. We may change pricing for future terms with reasonable notice; changes do not affect a term already paid for.

You own your data and your guests' data. Where we host or process data for you as part of a paid service, we do so on your instructions, and our handling of personal data is described in our Privacy Policy. You are responsible for having a lawful basis to collect and give us the data you put into Kamra, and for informing your guests and staff as your local law requires.
The software's copyright and licence are as stated in the project's
license.txt. The names "Kamra", "HeyKoala" and their logos are
our trademarks. The AGPL-3.0 licence to the code does not give you a licence
to our trademarks; please do not use them in a way that suggests we endorse
or are affiliated with your product or property without our written
permission.
Kamra can connect to services run by others, such as payment gateways, WhatsApp and the Meta Cloud API, email providers and online travel agencies. Your use of those services is governed by their own terms, and we are not responsible for them. Where you bring your own account or keys, you are responsible for that account and any charges it incurs.
We provide the paid services with reasonable skill and care. Beyond that, and to the fullest extent permitted by law, the website, the software and the services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the services will be uninterrupted or error-free.
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, goodwill or data. Our total liability to you arising out of or relating to a paid service is limited to the amount you paid us for that service in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
You may stop using the free software or the website at any time. For paid services, either party may end the agreement as described in the relevant order, and we may suspend a service if fees are overdue or if use materially breaches these Terms and is not fixed after we ask. On termination of Kamra Cloud, we will make your data available for export for a reasonable period before deleting it.
We may update these Terms from time to time. When we do, we will change the "last updated" date above and, for material changes to a paid service, give you reasonable notice. Continuing to use the services after a change takes effect means you accept the updated Terms.
These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute, except where your local consumer law gives you rights that cannot be waived.
